On July 28, 2020, GRSLBG&B’s Rey Villanueva obtained Summary Judgment in a personal injury matter in which Plaintiff allegedly sustained multi-level lumbar and cervical herniations and bulges. Plaintiff alleged that he was a passenger in a vehicle owned and operated by the Firm’s client, a New Jersey based taxicab company. Plaintiff alleged that the taxicab driver negligently operated his vehicle causing the Plaintiff to sustain severe and permanent injury. During the course of discovery, specifically responses to Demand for Admissions and Answers to Interrogatories, along with the deposition testimony of the Plaintiff, it was revealed that even providing every favorable inference to the Plaintiff and accepting Plaintiff’s version of the accident, no liability could be assessed against the taxicab company and its driver. Based upon the record and prevailing law, the Trial Court granted Summary Judgment.
