On August 10, 2020, GRSLBG&B’s Daniel McMeen and Alexis Carrelli obtained Summary Judgment in a personal injury matter in which Plaintiff allegedly sustained a fractured ankle and Complex Regional Pain Syndrome. Plaintiff, a truck driver, alleged that on March 16, 2017, he was caused to slip and fall on snow and ice in between two trucks. Plaintiff alleged that the owner of the subject property and GRSLBG&B’s client, was negligent for the happening of the accident as the owner had a duty to keep the property clear of snow and ice. During the course of discovery, specifically, responses to demand for documents and interrogatories, along with the deposition testimony of the parties, it was revealed that the owner was not responsible for the maintenance of the property, including snow and ice removal. In the subject lease agreement, the tenant, Plaintiff’s employer, was responsible for snow and ice removal, as well as other maintenance of the premises.
Based upon the record and prevailing law, the Trial Court granted Summary Judgment in favor of the owner as the Trial Court found that the owner did not owe a duty to the Plaintiff. Specifically, the Court found that the overwhelming evidence demonstrated that the owner was not responsible for snow and ice removal of the property, as they specifically relinquished those duties in the subject lease agreement. Additionally, the Trial Court found that the evidence demonstrated that instead, the tenant, was responsible for the snow and ice removal and it was unfair to impose that duty on the owner.
